END USER LICENCE AGREEMENT FOR COMBAT THEATER
This End User Licence Agreement (the “Agreement”) is a legal agreement between you (“Licensee”, “you”, or “your”) and Combat Theater Ltd, a company incorporated in the United Kingdom (“Licensor”, “we”, “us”, or “our”), governing your access to and use of the Combat Theater software, including any associated documentation, modules, updates, and related materials (collectively, the “Software”).
BY INSTALLING, ACCESSING, OR USING THE SOFTWARE, YOU AGREE TO BE BOUND BY THIS AGREEMENT. IF YOU DO NOT AGREE, YOU MUST NOT INSTALL, ACCESS, OR USE THE SOFTWARE.
If you are entering into this Agreement on behalf of an organisation, you represent that you have authority to bind that organisation.
1. PURPOSE AND AUTHORISED USE
Combat Theater is a professional security testing platform designed to emulate, exercise, and validate adversary techniques for defensive security research, training, detection engineering, and authorised security testing purposes only.
The Software is intended for use by technically skilled professionals. It may interact with operating system components, memory, processes, and system resources in non-standard ways, which may result in instability, disruption, or data loss.
You may only use the Software on systems for which you have explicit authorisation. You are solely responsible for ensuring your use complies with all applicable laws and regulations.
Use of the Software for any unlawful, unauthorised, or malicious purpose is strictly prohibited.
2. LICENCE TYPES
2.1 Professional Licence
A Professional Licence permits use of the Software solely for internal security testing, research, training, and validation within the Licensee’s own organisation.
Under a Professional Licence:
- Use on personal lab systems and infrastructure owned or controlled by the Licensee (including cloud environments) is permitted
- Use on third-party systems, client environments, or external engagements is prohibited
- The Software may not be used for consultancy services, managed services, or external assessments
- Outputs and reports may be used internally only
2.2 Enterprise Licence
An Enterprise Licence permits use of the Software for both internal and external security testing activities.
Under an Enterprise Licence:
- Use on third-party systems is permitted where explicit authorisation has been obtained
- Consultancy, red team, and purple team engagements are permitted
- Client-facing reports and deliverables are permitted
- There are no restrictions on the number of clients
Use of the Software in a manner inconsistent with the purchased licence type constitutes a material breach of this Agreement.
3. LICENCE GRANT
Subject to payment of applicable fees and compliance with this Agreement, the Licensor grants you a limited, non-exclusive, non-transferable, non-sublicensable licence to use the Software during the Licence Term.
- Licences are assigned to a single named user
- Each user must have their own licence
- Licences may not be shared between individuals
- Installation on virtual machines is permitted, provided the licence remains assigned to a single user
The Software is licensed, not sold. All rights not expressly granted are reserved.
4. LICENCE TERM AND EXPIRY
Licences are granted on an annual subscription basis and must be renewed manually.
Upon expiry of the licence term:
- The Software will cease functioning
- Continued use requires renewal and payment of applicable fees
5. PAYMENTS AND REFUNDS
Access to the Software is provided only after payment has been received.
- All licence fees are payable in advance
- Licences are non-recurring and must be manually renewed each year
Refunds may be issued at the Licensor’s discretion within 30 days of purchase, where the Licensee is unable to use the Software or is dissatisfied with its operation.
6. PERMITTED CUSTOMISATION AND EXTENSION
The Software includes supported interfaces for configuration, scripting, and extension.
You may:
- Configure techniques and workflows
- Create and execute playbooks
- Use documented APIs and scripting interfaces
You may not modify, reverse engineer, or derive source code from the Software outside of its intended extensibility.
7. RESTRICTIONS
You may not:
- Share, distribute, sublicense, or provide access to the Software to other users without appropriate licences
- Circumvent licensing mechanisms or technical controls
- Use a single licensed instance (including a VM) to provide access to multiple users
- Use the Software to develop, build, or assist in the development of competing products
- Use the Software for unlawful, unauthorised, or malicious purposes
8. RISK ACCEPTANCE
You acknowledge that security testing and technique emulation involve inherent risks.
The Software is not intended for use on production systems unless such risks are fully understood and accepted.
You are responsible for ensuring appropriate backups and safeguards are in place prior to use.
9. DISCLAIMER OF WARRANTIES
THE SOFTWARE IS PROVIDED “AS IS”.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE LICENSOR DISCLAIMS ALL WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
The Licensor does not warrant that:
- The Software will be error-free or uninterrupted
- The Software will meet your specific requirements
- The Software will detect, prevent, or simulate all relevant behaviours or threats
The Software does not guarantee detection coverage, security effectiveness, or completeness of results.
10. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- The Licensor shall not be liable for indirect, incidental, or consequential damages
- The Licensor shall not be liable for loss of data, profits, business, or goodwill
- Total liability shall not exceed the fees paid in the 12 months preceding the claim
11. INDEMNIFICATION
You agree to indemnify and hold harmless the Licensor from any claims arising from:
- Your use of the Software
- Your breach of this Agreement
- Your failure to obtain proper authorisation for testing activities
12. TERMINATION
The Licensor may terminate this Agreement immediately if:
- You breach any term of this Agreement
- You use the Software unlawfully or without authorisation
Upon termination:
- All rights granted under this Agreement cease immediately
- You must stop using the Software and delete all copies
13. CONFIDENTIALITY
The Software and any non-public information relating to it are confidential.
You agree not to disclose such information except as necessary for authorised use.
14. EXPORT AND COMPLIANCE
You agree to comply with all applicable export control and sanctions laws.
The Software may not be used, exported, or made available in violation of such laws, including in sanctioned jurisdictions.
15. GOVERNING LAW
This Agreement is governed by the laws of England and Wales.
The courts of England and Wales shall have exclusive jurisdiction.
16. MISCELLANEOUS
- This Agreement constitutes the entire agreement between the parties
- If any provision is unenforceable, the remainder remains in effect
- Provisions relating to liability, intellectual property, confidentiality, and indemnification survive termination
